1. Acceptance of Terms
By accessing or using the services provided by PMV Digital ("we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Services
PMV Digital provides professional website design, website development, and website hosting services. The specific scope, deliverables, timeline, and pricing for each project are outlined in a separate agreement or proposal provided to the client.
3. Pricing & Payment
- Pricing is as outlined in our published packages or in a custom proposal provided to you.
- Payment terms are specified in the project agreement. Typically, a deposit is required to begin work, with the balance due upon project completion or at agreed milestones.
- All prices are in U.S. dollars unless otherwise stated.
4. Project Timeline
We provide estimated timelines for each project. Timelines depend on timely client feedback and provision of required content and materials. Delays caused by the client may extend the project timeline.
5. Client Responsibilities
To enable us to deliver services effectively, the client agrees to:
- Provide accurate and complete information about their business and requirements.
- Provide content, images, and materials in a timely manner, or approve placeholder content.
- Provide feedback and approvals within agreed timeframes.
- Ensure they have the right to use any materials they provide to us.
6. Intellectual Property
- Upon full payment, the client owns the website design and content created specifically for their project.
- PMV Digital retains ownership of any pre-existing code, frameworks, tools, or materials used in the development process.
- PMV Digital reserves the right to display completed projects in our portfolio, unless otherwise agreed in writing.
7. Hosting & Maintenance
- Hosting is included as specified in the client's package or agreement.
- We strive for 99.9% uptime but do not guarantee uninterrupted service.
- We are not responsible for downtime caused by factors outside our control, including third-party service outages or force majeure events.
- We perform regular backups, but clients are encouraged to maintain their own backups of content.
8. Limitation of Liability
To the fullest extent permitted by law, PMV Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services. Our total liability for any claim arising from our services shall not exceed the amount paid by the client for the specific service giving rise to the claim.
9. Termination
Either party may terminate a project agreement with written notice. Upon termination, the client shall pay for all work completed up to the date of termination. Any deposit paid is non-refundable unless the termination is due to our failure to perform.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through good-faith negotiation, and if necessary, through the appropriate legal channels.
11. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the updated terms.
